Somalia’s Constitutional Review Commission Says MP–Minister Dual Roles End October 14

The Independent Constitutional Review and Implementation Commission (#ICRIC), mandated under Chapter 15 of the Constitution of the Federal Republic of Somalia (#FRS) to oversee its implementation, issues this release through Chairperson Burhan Adan Omar regarding Articles 81(f) and 117(3):

  1. The Constitution’s six-month deadline for aligning administrative measures with its ratified provisions expires on October 14, 2026. This period began when the Constitution took effect on April 14, 2026
  2. Effective October 14, 2026, Articles 81(1)(f) and 117(3)(a) will take effect, separating the roles of Member of Parliament and Minister.

A Minister who is also an MP will cease to be a member of the Council of Ministers; an MP who accepts another government position will forfeit their parliamentary seat.

  1. Implementing these provisions is a constitutional obligation. Article 4 establishes the Constitution, subject to Islamic Sharia, as the supreme law and requires all government institutions to comply with it.
